Volitare Studios — Terms of Service (EULA)
1) Scope & Structure
These Terms govern your use of all websites, apps, games, and online services operated by Volitare Studios LLC ("Volitare", "we", "us"). Product-specific Addenda apply in addition to these Terms. If an Addendum conflicts with the master Terms, the Addendum controls for that product.
2) Acceptance
By downloading, installing, or using any Service, you agree to these Terms. If you do not agree, do not use the Services. You must be 13+ (or the minimum age in your country) to create an account; if under 18, you need a parent/guardian’s consent.
3) License
We grant you a personal, limited, revocable, non-exclusive, non-transferable license to use the Services on compatible devices. Except as allowed by applicable law, you may not copy, sell, rent, sublicense, reverse engineer, or otherwise misuse the Services.
4) Accounts
Creating an account may be required for certain features (e.g., cloud saves, multiplayer, purchases). You are responsible for your login and for activity on your account. We may suspend or terminate accounts for violations of these Terms.
5) Virtual Items & Currency
Virtual items, cosmetics, currency, and similar benefits are licenses with no cash value. They are non-transferable and may be modified or discontinued.
6) Purchases & Subscriptions
Purchases and subscriptions are processed by platform providers (e.g., Apple App Store, Google Play). Prices may vary by region. Taxes may apply. Auto-renewable subscriptions continue until canceled; manage/cancel in your platform account settings. Refunds are handled by the platforms under their policies.
7) User Content & Conduct
You agree not to:
- harass, threaten, or abuse others;
- cheat, exploit bugs, or use automation/bots;
- attempt to access others’ accounts or our systems without authorization;
- post or transmit illegal, hateful, or infringing content (including usernames/avatars).
We may moderate or remove content and take enforcement actions in our reasonable discretion.
8) Third-Party Services
The Services may integrate third-party components (e.g., payments, ads, analytics, controller frameworks). Your use of those components is subject to their terms and policies.
9) Updates & Availability
We may update, change, suspend, or discontinue features or Services (including online features) at any time. Service interruptions may occur due to maintenance, failures, or factors beyond our control.
10) Ownership & IP
All rights, title, and interest in the Services (including code, art, music, and content) are owned by Volitare or its licensors. Except for the limited license granted, no rights are transferred.
11) Disclaimers
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
12) Limitation of Liability
To the fullest extent permitted by law, Volitare is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; and our total liability for any claim is limited to the greater of US$50 or the amount you paid to us for the Service in the 6 months prior to the claim.
13) Indemnity
You agree to indemnify and hold Volitare harmless from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or misuse of the Services.
14) Termination
You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms or if necessary to protect the Services, users, or our rights. Provisions that by their nature should survive termination will survive (e.g., Sections 10–13).
15) Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Venue and jurisdiction lie in the state and federal courts located in Riverside County, California.
16) Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (e.g., in-app or on our website). The “Last updated” date reflects the current version.
17) Privacy
Your use of the Services is also governed by our Privacy Policy.

Addendum GV-1 — RetroLumo
Product: RetroLumo (virtual console of original cartridge games)
Nature of Service
- Not an emulator: RetroLumo only runs games created for this platform by Volitare Studios.
Monetization & Content
- Coins: Earned through play and limited rewarded ads (frequency caps may apply).
- Gems (consumable IAP): Optional; consumables are not restorable and not refundable once delivered (subject to platform policies).
- Cosmetics/Items: Digital licenses only; no cash value; may be changed or discontinued.
Subscription
- Supporter Pass: Auto-renewing 1-month subscription (price may vary by region). Benefits may change; manage/cancel in platform settings.
Purchases & Restore
- Purchases follow your RetroLumo account for cross-platform use.
Multiplayer & Conduct
- Multiplayer is available on supported cartridges and requires an account.
- Anti-cheat, rate limits, and moderation measures may be used to protect fair play.
Controller Support
- Touch controls with optional haptics; Bluetooth controller support (compatibility may vary by device/platform).
